This manual is published in terms of section 51 of the Promotion of Access to Information Act, 2000 (Act 2 of 2000) ("PAIA"). It explains the types of records held by Eikendal Vineyards and how a person may request access to them.

2. The PAIA Guide
The Information Regulator has compiled a guide, in terms of section 10 of PAIA, containing information to help a person exercise their rights under PAIA and the Protection of Personal Information Act, 2013 (POPIA). The guide is available from the Information Regulator at inforegulator.org.za.
3. Records held by Eikendal
Eikendal holds records relating to the following categories. Some records are automatically available; others are subject to a request under PAIA.
- Company records — registration documents, statutory and governance records.
- Financial records — accounting records, invoices, banking and tax records.
- Personnel records — employment contracts and related human-resources records.
- Customer & member records — wine orders, bookings and Eikendal Club membership records (handled in line with our Privacy Policy).
- Operational records — supplier agreements, licensing (including liquor licensing), production and marketing records.
4. Records available without a formal request
Certain information is freely available on our Website, including product information, our Terms & Conditions and our Privacy Policy. These may be accessed without a PAIA request.
5. How to request access to a record
A requester must complete the prescribed PAIA request form and submit it to the Information Officer at the address above. The request must:
- provide enough detail to identify the record and the requester;
- identify the right the requester seeks to exercise (where access is requested for the protection of a right);
- specify the form of access required; and
- provide an address and contact details for the requester.
The prescribed forms and applicable fees are set out in the PAIA regulations. Eikendal will respond within the timeframes prescribed by PAIA.
6. Fees
Two types of fees may apply: a request fee and an access fee, calculated in accordance with the PAIA regulations. The Information Officer will notify the requester of any fee payable before processing the request.
7. Grounds for refusal
Access to a record may be refused on the grounds set out in Chapter 4 of PAIA, including the mandatory protection of the privacy of third parties, commercial information and records privileged from production in legal proceedings.
8. Remedies
If a request is refused, the requester may lodge a complaint with the Information Regulator or apply to court in accordance with PAIA.
